These Terms of Use ("Terms") constitute a binding agreement between you ("Affiliate") and Bulgar Invest Group S.R.O. ("Company", "we", "us", "our") regarding participation in the FX Navigator Affiliate Program ("Program"). By applying to or participating in the Program, you agree to be bound by these Terms.

The Program allows approved affiliates to earn commissions by promoting FX Navigator EA through authorized marketing methods. Your participation is subject to approval, and we reserve the right to accept or reject any application at our sole discretion.

To participate in the Program, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into this agreement
• Provide accurate and complete information during registration
• Maintain an active website, social media presence, or other marketing platform
• Comply with all applicable laws and regulations in your jurisdiction
• Not be located in a country subject to international sanctions

We may require additional verification or documentation to confirm your eligibility. Providing false information will result in immediate termination from the Program.

Commission Rates: Affiliates earn competitive commissions on qualifying sales generated through their unique affiliate links. Commission rates vary based on performance tiers and may include both one-time and recurring components for subscription products.

Qualifying Sales: Only completed purchases made through your authorized affiliate links qualify for commissions. Self-referrals, fraudulent transactions, and refunded purchases do not qualify.

Payment Schedule: Commissions become payable 30 days after the qualifying sale to account for refunds and chargebacks. Payments are processed monthly for affiliates who meet the minimum payout threshold of $100.

Payment Methods: We support PayPal, bank transfer, cryptocurrency, and Wise. You are responsible for any fees charged by your payment provider and for all applicable taxes on your commission earnings.

Commission Adjustments: We reserve the right to adjust commission rates with 30 days' notice. Existing commissions earned before the change will be honored at the original rate.

Marketing Standards: You must maintain professional marketing standards and accurately represent FX Navigator EA. All marketing materials must be truthful, non-misleading, and comply with applicable advertising laws.

Prohibited Activities: You may not:

• Make false or exaggerated income claims
• Use spam, unsolicited emails, or deceptive practices
• Bid on our trademarked terms in paid search campaigns
• Create websites that could be confused with our official sites
• Use cookie stuffing or other fraudulent tracking methods
• Promote through illegal or unethical channels
• Target vulnerable populations or minors

Compliance: You must comply with all applicable laws, including FTC disclosure requirements, GDPR, CAN-SPAM Act, and financial promotion regulations in your jurisdiction.

Approved Materials: We provide approved marketing materials, banners, and content through your affiliate dashboard. You may only use current, approved materials and must remove outdated content promptly.

Custom Content: If creating custom promotional content, you must ensure it accurately represents our products and includes appropriate disclaimers about trading risks. We reserve the right to request modifications or removal of any content.

Trademark Usage: You may use our trademarks only as explicitly authorized in approved marketing materials. You may not modify our logos or create derivative works without written permission.

Domain Names: You may not register domain names containing our trademarks or variations that could cause confusion.

Tracking System: We use cookies and tracking technology to attribute sales to your affiliate account. You must not interfere with or manipulate tracking mechanisms.

Reporting: Real-time statistics are available in your affiliate dashboard, including clicks, conversions, and commission earnings. We reserve the right to audit and verify all transactions.

Data Accuracy: While we strive for accurate tracking, technical issues may occasionally occur. Our tracking records are final and binding for commission calculations.

Cookie Duration: Referral cookies typically last 60 days, meaning you earn commissions on purchases made within this period after the initial click.

Affiliate Discounts: Qualified affiliates may receive unique discount codes to share with their audience. Discount percentages and terms are determined by the Company and may vary.

Usage Restrictions: Discount codes must not be shared on coupon sites, deal forums, or cashback platforms without explicit permission. Violation may result in code deactivation and commission forfeiture.

Promotional Periods: Special promotional rates or bonuses may be offered periodically. Terms for such promotions will be communicated separately.

During your participation in the Program, you may receive confidential information about our business, marketing strategies, commission structures, or upcoming promotions. You agree to keep all such information confidential and not disclose it to third parties without our written consent.

This confidentiality obligation survives termination of your participation in the Program.

Termination by Either Party: Either party may terminate this agreement at any time with written notice. Upon termination, you must immediately cease all promotional activities and remove affiliate links.

Immediate Termination: We may terminate immediately for:

• Violation of these Terms
• Fraudulent or deceptive practices
• Damage to our reputation
• Illegal activities
• Inactivity exceeding 180 days

Post-Termination: Commissions earned before termination will be paid according to the normal payment schedule, subject to verification. No commissions accrue after termination.

Disclaimer: The Program is provided "as is" without warranties. We do not guarantee any specific income level or results from participation.

Limitation: Our liability is limited to the amount of unpaid commissions owed to you. We are not liable for indirect, incidental, or consequential damages.

Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your participation in the Program, violation of these Terms, or infringement of third-party rights.

Modifications: We may modify these Terms at any time. Continued participation after changes constitutes acceptance.

Relationship: You are an independent contractor, not an employee, agent, or partner. You have no authority to bind us to any obligation.

Governing Law: These Terms are governed by the laws of the Czech Republic. Disputes shall be resolved through arbitration in Prague.

Entire Agreement: These Terms constitute the entire agreement between the parties regarding the Program.

Assignment: You may not assign your rights or obligations without our written consent.
